Section 1 — The Short Version

Section 2 — Who These Terms Apply To

These Terms of Service ("Terms") are a legal agreement between you and Wispera AI Inc. ("Wispera AI," "we," "us," or "our"), the company that operates Tea Leaves by Incremento ("Tea Leaves," "the product," or "the service").

"You" means any person who accesses or uses Tea Leaves, whether on a free tier or a paid plan.

These Terms apply to all use of the service, including via the web application at wispera.ai, id.wispera.ai, and any future mobile or API interfaces we make available.

Our Privacy Policy is incorporated into these Terms by reference. By accepting these Terms, you also accept our Privacy Policy.

Section 3 — Accounts and Access

3.1 Eligibility

You must be at least 18 years old to use Tea Leaves. By creating an account, you confirm that you meet this requirement. If we discover that an account was created by someone under 18, we will terminate it and delete all associated data.

3.2 Account Creation

You create an account using your email address via magic link or Google OAuth. You are responsible for maintaining the security of your account and for all activity that occurs under it. Do not share your login credentials or allow others to access your account.

3.3 Accurate Information

You agree to provide an accurate email address and to keep it current. We use your email to authenticate you and, if you have opted in, to send product communications. We do not require or request your real name.

3.4 One Account Per Person

Accounts are for individual use. You may not create accounts on behalf of others, resell access, or use one account to serve multiple users. Corporate or team plans, if and when offered, will have separate terms.

Section 4 — The Service

4.1 What Tea Leaves Does

Tea Leaves is a workplace intelligence tool. You input observations about your work environment — things you notice, people around you (identified only by pseudonym and animal archetype), and events that seem significant. The service processes these inputs and generates an AI-powered reading: a synthesised assessment of your company's probable situation, cast member dynamics, and likely outcomes.

4.2 What Tea Leaves Is Not

Tea Leaves is entertainment and pattern recognition. It is explicitly not:

• Legal advice about your employment situation, contracts, or rights
• Financial advice about your equity, compensation, or investments
• HR or career counselling
• A prediction about what will happen to you or your company
• A substitute for professional advice on any matter with legal or financial consequences

Every AI-generated reading includes the disclaimer: "This is entertainment and pattern recognition, not professional advice. The tea leaves are not liable for your career decisions." We mean this literally.

4.3 AI-Generated Content

The readings, analyses, and probability estimates produced by Tea Leaves are generated by artificial intelligence. AI outputs can be wrong, incomplete, or biased in ways that are not always apparent. We make no representation that any reading accurately reflects the reality of your situation. You should treat readings as one input among many, weighted accordingly.

4.4 Service Availability

We aim to keep Tea Leaves available and functional, but we do not guarantee uninterrupted access. We may perform maintenance, update the service, or experience outages. We will attempt to give reasonable notice of planned downtime where possible.

4.5 Service Changes

We may modify or discontinue features of the service. We will give reasonable notice of material changes. If we discontinue the service entirely, we will provide at least 30 days notice and give you the opportunity to export your data before shutdown.

Section 5 — Free Tier and Paid Plans

5.1 Free Tier

Tea Leaves offers a free tier with a limited number of signals (currently three). Free tier users have access to the core diagnosis, cast, and reading features within these limits. We reserve the right to adjust free tier limits with reasonable notice.

5.2 Paid Plans

Paid plans are offered on a subscription basis (currently weekly and monthly). Paid plan holders have unlimited signal logging and access to all features. Current pricing is displayed in the app and at wispera.ai.

5.3 Billing

Payments are processed by our payment processor (currently Stripe). By subscribing, you authorise us to charge your payment method on a recurring basis. You can cancel your subscription at any time from the Settings page; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods except where required by applicable law.

5.4 Price Changes

We may change subscription prices. We will give you at least 30 days notice before a price increase takes effect and will not charge you at the new rate without your affirmative agreement.

5.5 Referrals and Promotions

We may offer referral programmes or promotional pricing from time to time. These are governed by their specific terms, which will be presented at the time of the offer.

Section 6 — Your Content and Your Data

6.1 You Own Your Data

The signals, cast members, company profile, and other content you input into Tea Leaves belong to you. We do not claim ownership over your data.

6.2 Licence to Operate the Service

By inputting content into Tea Leaves, you grant Wispera AI a limited, non-exclusive, non-transferable licence to process, store, and use that content solely to operate and improve the service for you. This licence does not permit us to share your content with third parties, use it for advertising, or use it to train AI models.

6.3 Anonymisation

As described in our Privacy Policy, your content is anonymised before storage. Pseudonyms replace real names and role identifiers. The licence above applies to the anonymised data that reaches our database — not to the original text you typed, which is not retained after the anonymisation pass.

6.4 Export and Deletion

You can export all your data and delete your account at any time from the Settings page. Deletion is permanent. We do not retain your data after deletion beyond our standard 7-day backup rotation window.

6.5 No Use Against You

We will not use your data to take any action against you, to share information about you with your employer, or to identify you to any third party. The product is designed to protect you from your employer having this information, not to expose it.

Section 7 — Acceptable Use

You agree not to use Tea Leaves to:

• Violate any applicable law or regulation
• Harass, defame, or harm any individual
• Attempt to identify, expose, or harm any colleague through your use of the service
• Input content that is false, deliberately misleading, or designed to manipulate the AI into producing a predetermined output
• Attempt to reverse-engineer, scrape, or extract data from the service by automated means
• Circumvent access controls, rate limits, or security features
• Share, sell, or transfer your account to another person
• Use the service in a way that would violate your employment contract or applicable law — we are a tool for your personal awareness, not for corporate espionage or competitive intelligence gathering on behalf of a third party

We reserve the right to suspend or terminate accounts that violate these terms. We will use judgment in doing so and will not act on minor or ambiguous cases without warning where possible.

Section 8 — Disclaimers and Limitation of Liability

8.1 No Warranty

Tea Leaves is provided "as is" and "as available." Wispera AI makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or fitness for a particular purpose of any reading, analysis, or other output generated by the service.

8.2 AI Outputs Are Not Guarantees

Probability estimates are based on pattern recognition applied to the information you provide. They are not actuarial calculations, professional assessments, or predictions of specific outcomes. A 70% acquisition probability means the pattern matches historical acquisition scenarios approximately 70% of the time — it does not mean your company will be acquired.

8.3 Limitation of Liability

To the maximum extent permitted by applicable law, Wispera AI's total liability to you for any claim arising from or related to the service is limited to the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) USD $100. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost equity value, or career outcomes, even if we have been advised of the possibility of such damages.

8.4 Indemnification

You agree to indemnify and hold harmless Wispera AI, its officers, employees, and contractors from any claim, loss, or damage arising from your violation of these Terms or your misuse of the service.

8.5 Jurisdiction

Some jurisdictions do not permit limitations on implied warranties or liability. In those jurisdictions, the above limitations apply to the fullest extent permitted by law.

Section 9 — Intellectual Property

9.1 Our Property

The Tea Leaves product, Incremento brand, Wispera AI name and marks, the oracle voice and reading framework, the bestiary of company archetypes, the signal classification system, and all software, design, and content we create are the intellectual property of Wispera AI Inc. You may not reproduce, distribute, or create derivative works from any of these without our written permission.

9.2 Your Property

As stated in Section 6, your data belongs to you. Nothing in these Terms transfers ownership of your content to us.

9.3 Feedback

If you submit feedback, bug reports, or feature suggestions, you grant us a perpetual, royalty-free licence to use that feedback in the development of the product. We are not obligated to act on feedback or to attribute it.

Section 10 — Termination

10.1 Your Right to Cancel

You can cancel your subscription and delete your account at any time from the Settings page. Cancellation of a paid subscription takes effect at the end of the current billing period. Account deletion is immediate and permanent.

10.2 Our Right to Suspend or Terminate

We may suspend or terminate your account if you materially violate these Terms, if your account is involved in fraudulent activity, or if continued operation of your account poses a security or legal risk to the service or other users. We will give reasonable notice before termination where possible, except in cases of fraud or serious security incidents.

10.3 Effect of Termination

On termination, your access to the service ends. You can export your data before deleting your account; after deletion, we cannot recover it. Sections 6.1, 8, 9, and 11 survive termination.

Section 11 — Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Wispera AI Inc. is incorporated, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the service will be resolved through good-faith negotiation in the first instance. If negotiation fails, disputes will be resolved through binding arbitration or the courts of the applicable jurisdiction, as required by local law.

If you are located in the European Economic Area or the United Kingdom, nothing in these Terms affects your rights under mandatory local consumer protection law.

Section 12 — Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email (if you have one on file) at least 14 days before the changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms. If you do not agree to the changes, you can delete your account before they take effect.

We will not retroactively apply changes to these Terms to conduct that occurred before the change date.

The version history of these Terms is available on request.

Section 13 — Miscellaneous

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wispera AI Inc. regarding your use of Tea Leaves, and supersede any prior agreements.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.

No Waiver. Our failure to enforce any provision of these Terms does not waive our right to enforce it in the future.

Assignment. You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets, provided that the acquiring entity agrees to honour these Terms.
